中文摘要法经济学理论认为，所有法律活动，包括一切立法和司法以及整个法律制度，都可以用经济的方法来分析和指导。法经济学正因其讨论方法的独特性而成为一个独立的法学流派。它不仅涉及到有关法律价值等具有法哲学意义上的法学理论问题，而且涉及到具体的法律问题和几乎所有的部门法领域。首先，本论文通过简述法经济学建立的必要性，简单的说，就是本论文的写作目的。其次，再通过论述法经济学在我国尚未成形的原因，引出下文的对国外法经济学有关理论的借鉴与思考。最后，从法经济学角度，对我国法制建设提出几点对策与建议。关键词：法经济学；法制建设；立法；法经济学分析AbstractLaw and economics theory suggests that all legal activities, including all legislative and judicial as well as the whole legal system, the method can be used to analyze economic and guidance.
