本科毕业设计-论严格限制死刑适用

中文摘要现阶段，随着人类文明不断进步，具体国情、传统观念、民意、经济、司法状况等因素的制约，要彻底废除死刑制度是不可行的。因此务实的方法是进行改革,即通过完善相关制度来严格限制死刑的适用，这样做有利于提高死刑的威慑力，有利于我国各个地区的法制统一，还有利于更好发挥司法机关的职能。本文通过分析严格限制死刑适用意义和现行死刑制度在政策、立法、司法方面的缺陷，对如何严格限制死刑的适用提出了建议。关键词：死刑；死刑复核；刑事政策 AbstractNowadays，with the progress of culture，it is impossible to abolish death penalty with the restrict of state system，public opinion ， economy and administration of justice. So it is feasible to reform. In another word，the state should limit death penalty strictly through reform the system of policy，legislation，justice，which is good for heightening the deterrent force of death sentence ， unify of our country and give full play to judicial functions. The paper give some suggestions to solve these problem though anglicizing the significance of limiting death penalty strictly and the obstacles in policy ，legislating and judicial .KEY WORDS: The death penalty ；judicial review of the death penalty ；criminal policy试论严格限制死刑适用死刑作为一种最古老最严厉的刑罚方式，历来倍受我国统治阶层的推崇和青睐。几千年来，“以牙还牙、杀人偿命” 的观念在人们的内心深处根深蒂固，死刑作为人们传统理念中昭彰天理、惩恶扬善最有力、最有效的保障，可以说在以“功利主义”和“报应主义”为主导的社会里，死刑的存在是实现正义和公平的必要手段，其存在的合理性不容置疑。但随着人类文明不断进步，死刑的存废问题曾一度在中世纪的欧洲引起争议。在当前世界人权运动方兴未艾的社会历史背景下，死刑成为人们关注的焦点。 许多国家和地区纷纷以“保障人权”和“人道主义”为目的废除或严格限制死刑制度。我国作为保留死刑制度的国家之一，受具体国情、传统观念、民意、经济、司法状况等因素的制约，现阶段要彻底废除死刑制度是不可行的，但为适应经济文化进展的时代要求和国际刑罚改革的进展趋势，笔者认...
