论倒签提单的效力和后果[摘要]倒签提单是指货物装船后签发的以早于货物实际装船日期为签发日期的一种提单。由于倒签提单行为影响国际贸易的秩序，相关规则对其效力及其后果规定不明，导致倒签提单时权利受侵害方有时难以得到有效的救济。倒签提单法律效力有效论观点比无效论更为合理，关于倒签提单的后果，责任竞合的承担方式更有利于受害人的权利保护。[关键词]倒签提单；效力分析；责任承担[Abstract]Anti-dated B/L is the bill of lading issued after the merchandise are loaded but has an issued date prior to the actual loading date.The anti-dated B/L negatively affects the order of international trade, but the law does not have specific guidelines and consequences regarding this issue.Therefore, the victims from anti- dated B/L cannot receive effective help most of the time. In the legal field，the viewpoint from the theory of validity of the Anti-dated B/L is more reasonable than the theory of invalidity ,regard to the consequences of Anti-dated B/L,the way of undertaking for concurrent liability is more conducive to protect the injured party's rights.[Key words] Anti-dated B/L; Effectiveness analysis; responsibility在经济全球化的大背景下，各国经济交往愈加频繁。海事运输打破了各国地域的局限性，提单成为发货运输取货的凭证，然而在实际中产生的倒签提单行为，由于缺乏明确的立法规定，使得倒签提单在实践中的效力认定及后果认定上容易产生各种纠纷，这些纠纷如果不进行明确的界定将不利于当事人的权利保护，也不利于国际货物运输中的行为规范。一、倒签提单概述（一）倒签提单的概念和特征提单，是指“用以证明海上货物运输合同和货物已经由承运人接收或者装船，以及承运人保证据以交付货物的运输单证。”[1]然而，在实际的海上货物运输中，并不是中规中矩的按照提单上的时间来提交货物的，因此而有了倒签提单。1.倒签提单的概念关于倒签提单，不同的学者、论著有不同的阐释和定义。大连海事大学的司玉琢教授认为“倒签提单（anti-dated B/L）是指在货物装船后签发的，以早于货物实际装船日期为签发日期的提单。”[2] 南昌大学的钟筱红教授认为：“倒...
