论我国依法行政——完善对人大代表的监督机制分析研究 法学专业

摘 要从我国目前的立法状况和社会实际情况出发，深入分析对人大代表行使权力的监督，发现：人大代表在选举过程中缺乏切实可行的有效的监督；人大代表在人民代表大会闭会期间的工作缺乏监督；选民对人大代表的罢免的条件和程序不够明确等问题。因此，完善对人大代表的监督机制就迫在眉睫了。完善对人大代表的监督机制，一是在人大代表的选举过程中要实行“公示制度”，对人大代表候选人要进行严格的资格审查；二是进一步明确人大代表的责任，尤其是闭会期间的工作考评制度；三是把罢免人大代表的条件具体化、程序化。通过加强对人大代表行使权力的监督，使人大代表产生较大的压力和动力，增强其责任感和危机感和使命感，更好地发挥人大代表代表人民管理国家和社会事务的作用，使我国的人民代表大会制度更加完善。关键词：人民代表大会制度；人大代表；人民监督AbstractFrom the present situation of the legislation and the social reality, in-depth analysis of the supervision, the exercise of the power of NPC deputies found: lack of effective supervision in the process of electing deputies to the National People's Congress during the intersessional period; the lack of supervision of people's Congress; voters recall conditions is not clear enough.
