论我国依法行政——行政权力监督制约机制的完善分析研究 法学专业

摘 要从我国目前的立法状况和社会实际情况出发，深入分析对人大代表行使权力的监督，发现：人大代表在选举过程中缺乏切实可行的有效的监督；人大代表在人民代表大会闭会期间的工作缺乏监督；选民对人大代表的罢免的条件和程序不够明确等问题。因此，完善对人大代表的监督机制就迫在眉睫了。完善对人大代表的监督机制，一是在人大代表的选举过程中要实行“公示制度”，对人大代表候选人要进行严格的资格审查；二是进一步明确人大代表的责任，尤其是闭会期间的工作考评制度；三是把罢免人大代表的条件具体化、程序化。通过加强对人大代表行使权力的监督，使人大代表产生较大的压力和动力，增强其责任感和危机感和使命感，更好地发挥人大代表代表人民管理国家和社会事务的作用，使我国的人民代表大会制度更加完善。关键词：人民代表大会制度；人大代表；人民监督AbstractStarting from the present situation of the legislation and the actual social situation, in-depth analysis of the supervision, the exercise of the power of National People's Congress of the people's Congress found that the lack of effective supervision in the process of electing deputies to the inter sessional work; lack of supervision of the people's Congress; problems of the conditions and procedures of voters recall of National People's Congress is not enough clear.
